Metrex Research, LLC (“Company”) provides the following standard limited warranties (limited by the time period specified, if any) on the components and features of its Orascoptic loupe (the “Product”) in according with the General Terms and Conditions that follow:

1 – Standard Limited Warranty

  • 5-YEAR LIMITED LIFETIME WARRANTY on all telescopes

  • 3-YEAR LIMITED WARRANTY on non-powered frames, headbands, carrier lenses, flip-up hinges, OmniOptic™ anchors, and adhesives.
  • 2-YEAR LIMITED WARRANTY on the XV1™ and Dragonfly™ powered frames, headlights, and electrical components 
  • 1-YEAR LIMITED WARRANTY on XV1™ and Dragonfly™ batteries
  • 1-YEAR LIMITED WARRANTY on accessory items 
  • 45-day Returns or Exchanges 

2 – “Peace-of-Mind” Extended Warranty (available for purchase at time of Product purchase)

  • 5-YEAR LIMITED LIFETIME WARRANTY on all telescopes

  • 4-YEAR LIMITED WARRANTY on non-powered frames, headbands, carrier lenses, flip-up hinges, OmniOptic™ anchors, and adhesives.
  • 4-YEAR LIMITED WARRANTY on the XV1™ and Dragonfly™ powered frames, headlights, and electrical components 
  • 4-YEAR LIMITED WARRANTY on accessory items, maintenance and cleaning, and prescription changes
  • 1-YEAR LIMITED WARRANTY on XV1™ and Dragonfly™ batteries
  • Covers ordinary wear & tear and accidental damage
  • 45-Day Exchanges Only, No 45-Day Returns

Endeavour™, Endeavour™ XL, and Endeavour™ MD LED Light Systems 

Company provides the following standard limited warranty on the Endeavour, Endeavour XL, and Endeavour MD LED Light System components in accordance with the General Terms and Conditions that follow: 

  • 24 MONTHS LIMITED WARRANTY for control pack, charger, cable, and headlight 

  • 12 MONTHS LIMITED WARRANTY for accessories 

Spark™ LED Light System

Company provides the following standard limited warranty on the Spark LED Light System components in accordance with the General Terms and Conditions that follow below: 

  • 24 MONTHS LIMITED WARRANTY for control pack, charger, and headlight 

  • 12 MONTHS LIMITED WARRANTY for accessories 

Ease-In-Shields™ Laser Inserts

Company provides the following standard limited warranty on Ease-In-Shields laser inserts in accordance with the General Terms and Conditions that follow below: 

  • 12 MONTHS LIMITED WARRANTY 

Warranty General Terms and Conditions

Limited Warranty.  For each of the above limited warranties, during the time periods specified, Company warrants that the Products, when new, and for the time period specified, will be free of defects in material and workmanship, and will perform in accordance with manufacturer’s specifications, when subject to normal use and service from Company or its authorized agent. The warranty period begins on the original date of purchase of the Product from Company. The above warranties apply only to purchasers in the United States of America (USA), Canada, UK, Spain, Portugal, or to units sold to and by authorized and approved international dealers. These warranties are non-transferable and shall only apply to the original purchaser of the Product, as exclusively contained in Company’s records.

Exclusions.  The above warranties are limited and do not cover normal wear and tear, accidents, neglect, damage caused by shipping, improper maintenance or handling, improper installation, servicing, repair or cleaning procedures  The above warranties also do not cover breakage or failure due to (a) tampering or misuse, inappropriate use, modification, or relocation, (b) contact with fluids or moisture or extreme heat or climatic conditions and/or short term variations in relevant influences or corrosion, oxidation, (c) unauthorized intervention or attempts at connection or impact with other objects or attachments, dropping, falls, theft, rust, corrosion, contact by animals or insect infestation, (d) unauthorized opening or repair or repair attempts with unacceptable replacement parts, (e) use of hardware systems for purposes other than those for which it was designed, (f) forces majeure such as fire, flood, wind, earthquake or lightning, or (g) chemical influences or other influences over which Company has no control (including deficiencies to operational parts such as batteries that only have a limited lifespan, as well as damage to cables).  The above warranties also do not cover damage due to (i) lost or stolen items, or cosmetic damage that does not hinder the performance of the Products, (ii) usage not in accordance with manufacturer’s recommendations or instructions, (iii) servicing of the Product by a party other than Company or its authorized agent, or (iv) painted or otherwise personalized parts.  For all warranties, Product must bear the serial number (serial number has not been removed, scratched off, crossed out, changed or otherwise rendered illegible) and customer must report the deficiency within 30 days of its discovery.  Only Company Products are covered under these warranties. Company makes no warranty and shall have no liability with respect to the support, service or performance of any computers, peripherals (including printers and sensor controller readers), third party software, third party hardware, and all other third party items, whether supplied by Company or a third party, that are integrated into the Products. 

Extended “Peace-of-Mind” Limited Warranty.  Notwithstanding the above, upon payment in full for the extended “Peace-of-Mind” Limited Warranty, customer shall be entitled, at Company’s option, to repair or replacement of any defective Product for all defects except damage resulting from (i) lost or stolen items, or cosmetic damage that does not hinder the performance of the Products, (ii) usage not in accordance with manufacturer’s recommendations or instructions, or (iii) servicing of the Product by a party other than Company or its authorized agent.  For all warranties, Product must bear the serial number (serial number has not been removed, scratched off, crossed out, changed or otherwise rendered illegible) and customer must report the deficiency within 30 days of its discovery.  The Extended Peace-of-Mind Limited Warranty is non-refundable.

Warranty Remedy. During the warranty period, defective Product will be, at the sole discretion of Company, either repaired or replaced. The customer will receive either the repaired unit or a comparable replacement unit from Company. There is no extended or renewed warranty period for repaired or replaced parts. Exchanged parts or accessory parts become the property of Company. It shall be the customer’s responsibility to return the product in appropriate packing materials, so as to prevent accidental breakage in transit, and sufficiently cleaned and disinfected, directly to Company or one of its authorized agents. Company reserves the right, at its sole discretion, to refuse to repair or replace the Product if the Product is deemed to be unsanitary. It will be the responsibility of the purchaser to arrange for the Product to be returned to the purchaser for appropriate cleaning and sanitation, and the purchaser shall be responsible for all shipping charges.

Limitation of Liability. IN NO EVENT SHALL COMPANY OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES OR AGENTS BE LIABLE TO YOU FOR ANY LOSS OF USE, LOSS OF BUSINESS, LOSS OF DATA, LOSS OF REVENUE, LOSS OF PROFITS, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, EVEN IF COMPANY HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH DAMAGES AND WHETHER SUCH DAMAGES ARE BASED IN TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), CONTRACT, OR OTHERWISE. COMPANY’S ENTIRE LIABILITY TO YOU FOR ANY DAMAGES ARISING IN CONNECTION WITH THE COMPANY SYSTEM(S) OR THE PLAN(S) SHALL NOT, IN ANY EVENT, EXCEED THE TOTAL AMOUNT PAID TO COMPANY BY YOU FOR THE PRODUCT.  CUSTOMER’S SOLE REMEDY, AND COMPANY’S SOLE LIABILITY, IS TO SEEK DIRECT DAMAGES IN AN AMOUNT NOT EXCEEDING THE FOREGOING LIMITATION. THE ABOVE STATES CUSTOMER’S SOLE AND EXCLUSIVE REMEDY EVEN IF SUCH REMEDY SHOULD FAIL OF ITS ESSENTIAL PURPOSE.

Disclaimer of Warranty. THESE WARRANTIES ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER STATEMENTS, WARRANTIES OR GUARANTEES BY METREX RESEARCH LLC OR ITS AUTHORIZED REPRESENTATIVE, INCLUDING WARRANTIES WITH RESPECT TO DESCRIPTION, QUALITY, TITLE, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. METREX RESEARCH LLC HEREBY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED. The limits and exclusions contained herein shall apply unless otherwise prohibited by applicable law.

Acknowledgement. CUSTOMER ACKNOWLEDGES AND AGREES THAT THE
FOREGOING DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY ARE ESSENTIAL ELEMENTS OF THIS AGREEMENT, AND THAT COMPANY WOULD NOT BE WILLING OR ABLE TO OFFER THE OTHER TERMS UNDER THIS AGREEMENT WITHOUT BEING ABLE TO RELY ON THE EXISTENCE AND ENFORCEABILITY OF THE DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY SET FORTH ABOVE.
